RE: The tariff classification of nipples, tubing and fittings.
Dear Ms. Vybiral:
In your letter dated January 27, 2003, you requested a tariff classification ruling.
You have described your samples as follows:
Hastelloy C276 nipples – They are nickel alloy coned and threaded pieces of tubing, used to interconnect valves and fittings. They come in medium or high pressure, for up to 150,000 psi. These nipples are up to 12” in length.
Zirconium tubing – They are low, medium and high pressure seamless tubing ranging in size of 1.59 mm to 25.4 mm in diameter and lengths exceeding 12 feet. They are used in the high-pressure fluid handling industry, with applications in chemical, petrochemical research and oil and gas industries.
Zirconium nipples - They are coned and threaded pieces of tubing, used to interconnect valves and fittings. They come in medium or high pressure, for up to 150,000 psi. These nipples are up to 12” in length.
Stainless steel elbows (fittings) – They are threaded stainless steel elbow fittings used to connect tubes in the high-pressure fluid handling industry.
Stainless steel straight/union/bulkhead couplings, sleeves (fittings) - They are used to connect tubes in the high-pressure fluid handling industry.
The applicable subheading for the zirconium tubing and nipples will be 8109.90.0000, HTS, which provides for zirconium and articles thereof, including waste and scrap: other.
The applicable subheading for the stainless steel elbows (fittings) will be 7307.22.5000, HTS, which provides for tube or pipe fittings (for example, couplings, elbows, sleeves), of iron or steel: other: of stainless steel: threaded elbows, bends and sleeves: other.
The applicable subheading for the stainless steel straight/union/bulkhead couplings, sleeves (fittings) will be 7307.22.1000, HTS, which provides for tube or pipe fittings (for example, couplings, elbows, sleeves), of iron or steel: other: of stainless steel: threaded elbows, bends and sleeves: sleeves (couplings).
Your inquiry does not provide enough information for us to give a classification ruling on Hastelloy C276 nipples. You indicate they interconnect valves and fittings. Your request for a classification ruling should include an explanation as well as diagrams and or literature indicating how these nipples function. What are they connecting the valves and fittings to? Are they connecting a valve to a tube? Are they intended to connect fittings to fittings? When this information is available, you may wish to consider resubmission of your request.
This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
